These Terms of Service ("Terms") form a binding agreement between you and Lumi Swift LLC ("Lumi Swift," "we," "us," or "our"), a Wyoming limited liability company, governing your access to and use of lumiswift.com and any products or services offered through it (the "Site"). By accessing or using the Site, or by purchasing any product, you agree to these Terms. If you do not agree, do not use the Site.

1. About Us and Our Products

Lumi Swift LLC provides two categories of products:

Digital products — website themes and email template bundles, delivered electronically.
Physical products — curated goods such as desk accessories and drinkware, shipped to a delivery address.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase from the Site. By placing an order, you represent that you meet this requirement.

3. Site Availability

Lumi Swift is currently in a pre-launch phase. Payment processing is being finalized, and some or all products may not yet be available for purchase. Where a product cannot currently be purchased, the Site will clearly indicate this and offer a "notify me" option rather than an active checkout.

4. Digital Products & License Grant

When you purchase a digital product from Lumi Swift, you are granted a limited, non-exclusive, non-transferable license to use the files for your own personal or business projects, subject to the following restrictions unless otherwise stated in writing:

You may not resell, redistribute, sublicense, or share the original template or theme files as a standalone product.
You may use a purchased template as the basis for a single end product (e.g., one website or one email campaign build) unless a multi-use or extended license is separately purchased.
You may not claim authorship of the original template design.
Lumi Swift LLC retains all underlying intellectual property rights, including copyright, in its digital products. Purchasing a product grants a license to use it — it does not transfer ownership of the underlying design or code.

Because digital products are delivered electronically and license rights attach immediately upon delivery, all digital product sales are final. See our Refund Policy for details.

5. Physical Products

Physical products are shipped to the address provided at checkout once shipping is enabled. Risk of loss and title for physical products passes to you upon our delivery to the carrier. See our Shipping & Delivery page for further detail.

6. Pricing and Payment

All prices are listed in USD unless otherwise stated and do not include applicable sales tax, which will be calculated and added at checkout once payment processing is live. We reserve the right to correct pricing errors and to change prices at any time prior to a completed purchase.

7. Intellectual Property

All content on the Site — including text, graphics, logos, product designs, and the "Lumi Swift" name and branding — is the property of Lumi Swift LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our prior written consent, except as expressly permitted under Section 4 for licensed digital products you have purchased.

8. Prohibited Uses

You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to gain unauthorized access to the Site or its systems; (c) upload malicious code; (d) scrape or harvest data from the Site without permission; or (e) infringe on the intellectual property rights of Lumi Swift LLC or any third party.

9. Disclaimer of Warranties

The Site and all products are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are not permitted by law.

10. Limitation of Liability

To the fullest extent permitted by law, Lumi Swift LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Site or any product purchased through it. Our total liability for any claim arising from these Terms or your purchase shall not exceed the amount you paid for the product giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless Lumi Swift LLC from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the Site.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Site shall be resolved in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of such courts.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms. The "Last updated" date below reflects the most recent revision.
